These Terms govern your use of the 4x4 Trails India, 4x4 Events India, 4x4 Clubs India, 4x4 Tracks India and 4x4 Garages India directories (the "Directories"), operated by PRODM IT Solutions, Bengaluru, Karnataka, India ("we", "us", the "Operator"). By using the Directories you agree to these Terms. If you do not agree, do not use them.
1. Nature of the service (discovery-only / not an operator)
- The Directories are information and discovery platforms only. We are NOT an operator, organiser, guide, instructor, tour or travel company, booking or ticketing agent, payment intermediary, or certifying/permitting authority.
- We do not create, survey, inspect, verify, endorse, run, supervise, insure, or take bookings or payments for any listing. Any transaction, booking, permit or payment is strictly between you and the relevant organiser, landowner, authority or third party via their own official channels.
- 4x4 Garages India lists car and 4x4 workshops and automotive service businesses, compiled from public sources and, where available, owner submissions. A listing is not a recommendation or certification, nor a statement that a business is authorised by any vehicle manufacturer. We do not perform, inspect, warrant, or take bookings for any repair, service, or modification — arrange those directly with the business.
2. No warranty ("as is") + AI-assisted disclosure
- All listings, descriptions, maps, coordinates, GPS/GPX data, distances, timings, fees, permits, images and other content are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, to the fullest extent permitted by law.
- Content is compiled from public sources and drafted or enriched with the assistance of artificial intelligence, then only lightly reviewed. It is general information, not verified fact, professional advice, or a safety, legality or fitness assessment. We do not warrant that any listing is accurate, complete, current, safe, passable, permitted, or lawful, and conditions can change without notice.
- Representative images are illustrative only (labelled where shown) and do not depict any actual place, route, animal, or event. Do not rely on the Directories for navigation, safety-critical decisions, or in an emergency.
3. Assumption of risk
- You acknowledge that off-road / 4x4 driving, recovery, water crossings, high-terrain travel, wildlife safaris and related activities are inherently and seriously dangerous and can result in injury, death, or loss of or damage to vehicles and property, and that trails and areas may be unmarked, unmaintained, closed, private, or protected. You voluntarily assume all such risks.
- Before you travel, pay, enter or drive, you are solely responsible for independently verifying that the route or event is accurate, currently open, legal for you to enter (including any Forest Department / protected-area or private-land permit), and within the capability of you, your vehicle and your group, and for carrying proper recovery gear, offline navigation, and a means to call for help. You participate entirely at your own risk and on your own judgement, not in reliance on the Directories.
4. Limitation of liability
- To the maximum extent permitted by applicable Indian law, PRODM IT Solutions and its proprietor, and their agents, shall not be liable for any loss, injury, death, illness, damage, theft, seizure, fine, prosecution, cost, or claim of any kind — whether direct, indirect, incidental, special or consequential, and whether in contract, tort, statute or otherwise — arising out of or in connection with your use of the Directories, any listing or content, or any trail, route, safari, event or activity you undertake or attend.
- Where any liability cannot lawfully be excluded, our total aggregate liability to you for all claims is limited to INR 1,000 (one thousand rupees).
- Nothing in these Terms excludes or limits liability that cannot be excluded under Indian law, including for fraud, wilful misconduct, or our own gross negligence; and nothing affects your non-excludable statutory rights under the Consumer Protection Act, 2019.
5. Indemnity
- You agree to indemnify, defend and hold harmless PRODM IT Solutions and its proprietor from any claim, demand, loss, liability, fine, penalty, cost or expense (including reasonable legal fees) arising out of or connected with: (a) your use of the Directories or any listing; (b) any trail, route, area or event you enter, drive, attend, book or pay for; (c) your breach of these Terms or of any law (including trespass on private land or entry into Forest / protected / wildlife areas without a required permit); or (d) any content you submit. This clause survives termination and applies to the extent permitted by Indian law.
6. User submissions & intermediary status
- Some listings are submitted by members of the public. For such content we act only as an intermediary within the meaning of section 2(1)(w) of the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021; we do not author, endorse or verify it.
- If you submit content you warrant it is accurate to your knowledge, lawful, non-infringing, and does not encourage trespass or entry into Forest / protected / wildlife areas without a required permit under the Indian Forest Act 1927, the Wildlife (Protection) Act 1972, or the Forest (Conservation) Act 1980.
- To report content, contact our Grievance Officer (contact@prodmitsolutions.com); we act in accordance with the IT Rules 2021 (acknowledge within 24 hours, resolve within 15 days) and may remove or disable access to such content. Listing a trail, event or location is not permission to enter it, not a certification that it is safe or legal, and not an endorsement of any organiser.
7. Third-party names & trade marks
- We reference real-world events, organisers, places and brands by name only to identify them so users can find and independently verify information. All third-party names, brands, logos and trade marks are the property of their respective owners.
- Their appearance does not indicate any affiliation, sponsorship, authorisation, partnership or endorsement, and we are not an organiser, certifier, ticketing or booking agent for any listed event or trail. We use such names descriptively and nominatively (Trade Marks Act 1999, sections 30 and 35) and use no third party's logo or trade-dress as a badge of our own service. Brand/event owners may contact our Grievance Officer for prompt correction or removal.
8. Discovery-only, no booking or transaction
- We do not take payments, sell tickets, issue or arrange permits, or handle any booking. Any payment you make is with a third party at your own risk; be alert to unofficial resellers and confirm on the official source first.
9. Governing law & jurisdiction
- These Terms and any dispute arising out of or in connection with them or your use of the Directories are governed by the laws of India. Subject to any written arbitration the parties agree, the courts at Bengaluru, Karnataka, India shall have exclusive jurisdiction. The parties will first attempt in good faith to resolve any dispute amicably before commencing proceedings.
